These Terms govern your use of www.lxryhaus.com and any text message program operated by LXRY HAÜS. By using the website, submitting a form, requesting an estimate, or enrolling in text messages, you agree to the applicable provisions below. A separate written project agreement controls any roofing, siding, windows, turf, or other home-improvement work you purchase from us.

Part One Website Terms and Conditions

1 Acceptance of Terms

These Website Terms and Conditions are a binding agreement between you and LXRY HAÜS. If you do not agree to them, do not use the website. If you use the website for a company or another person, you represent that you have authority to bind that party to these Terms.

2 Eligibility

You must be at least 18 years old and legally able to enter into a contract to use the website or submit a request for services. The website is intended for users located in the United States.

3 Website Information and Services

The website provides general information about LXRY HAÜS and allows users to request information, estimates, inspections, appointments, financing information, and other services. Website content is provided for general informational purposes. It is not a construction contract, engineering opinion, insurance determination, financing approval, warranty, or guarantee of price, availability, savings, timing, or results.

Any estimate, proposal, scope of work, financing disclosure, warranty, or project agreement that we provide separately may contain additional or different terms. If those documents conflict with these Website Terms, the signed project-specific document controls for that project.

4 Estimates Offers and Financing

Estimates and promotional offers are subject to inspection, eligibility requirements, product availability, property conditions, geographic availability, and written confirmation. Images and project examples may be illustrative. Colors, textures, dimensions, materials, and completed results can vary.

Financing, if offered, is provided by third-party lenders and is subject to credit approval and the lender's terms. LXRY HAÜS does not guarantee approval, rates, payment amounts, or financing availability unless a signed document expressly states otherwise.

5 User Information and Submissions

You agree to provide accurate, current information when you submit a form, request an appointment, upload content, or communicate with us. You may not submit information that you do not have the right to provide.

If you submit photographs, plans, reviews, comments, or other materials, you grant LXRY HAÜS a nonexclusive, royalty-free license to use them as reasonably necessary to respond to you, evaluate or perform requested services, maintain business records, and protect legal rights. We will not use customer photographs or testimonials in public advertising without any additional permission required by law or by our agreement with you.

6 Acceptable Use

You may use the website only for lawful purposes. You may not:

interfere with the website, its security, or another user's access;

attempt to gain unauthorized access to accounts, systems, or data;

introduce malware, automated scraping tools, or excessive requests;

impersonate another person or misrepresent your identity or authority;

use website content to compete unlawfully with LXRY HAÜS or violate intellectual-property rights; or

use the website in a way that violates applicable law.

7 Intellectual Property

The website and its text, graphics, photographs, video, layout, trademarks, logos, and other content are owned by or licensed to LXRY HAÜS and are protected by applicable intellectual-property laws. 10 Electronic Communications

When you communicate with us electronically, you consent to receive responsive electronic communications from us. Transactional communications may include appointment confirmations, estimate updates, project notices, service messages, account notices, and responses to your requests. Marketing text messages are governed by Part Two and require the consent described there when applicable.

11 Website Availability and Changes

We may change, suspend, or discontinue any part of the website at any time. We do not guarantee uninterrupted or error-free access. We may correct errors or update content without notice.

12 Disclaimer of Warranties

TO THE FULLEST EXTENT PERMITTED BY LAW, THE WEBSITE AND ITS CONTENT ARE PROVIDED AS IS AND AS AVAILABLE. LXRY HAÜS DISCLAIMS ALL WARRANTIES REGARDING THE WEBSITE, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. THIS DISCLAIMER DOES NOT ALTER WARRANTIES EXPRESSLY PROVIDED IN A SIGNED PROJECT AGREEMENT AND DOES NOT EXCLUDE RIGHTS THAT CANNOT LAWFULLY BE WAIVED.

13 Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, LXRY HAÜS AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM OR RELATED TO THE WEBSITE, EVEN IF ADVISED THAT SUCH DAMAGES ARE POSSIBLE. FOR CLAIMS BASED SOLELY ON USE OF THE WEBSITE AND NOT ON A SIGNED PROJECT AGREEMENT, LXRY HAÜS'S TOTAL LIABILITY WILL NOT EXCEED ONE HUNDRED DOLLARS. THESE LIMITATIONS DO NOT APPLY TO LIABILITY THAT CANNOT BE LIMITED BY LAW.

14 Indemnification

To the extent permitted by law, you agree to defend, indemnify, and hold harmless LXRY HAÜS and its owners, officers, employees, contractors, and agents from claims, losses, liabilities, and reasonable costs arising from your unlawful use of the website, your violation of these Terms, or content you submit. This section does not require you to indemnify any party for that party's own unlawful conduct.

15 Governing Law and Disputes

Utah law governs these Terms, without regard to conflict-of-law principles. Any lawsuit arising solely from these Terms or the website must be brought in a state or federal court located in Utah, and each party consents to that court's jurisdiction. A signed project agreement may contain a different dispute process that controls disputes relating to that project.

16 Termination

We may restrict or terminate your access to the website if we reasonably believe you violated these Terms, created a security risk, or used the website unlawfully. Provisions that by their nature should survive termination will remain in effect, including intellectual-property, disclaimer, limitation-of-liability, indemnification, and dispute provisions.

17 Changes to These Terms

We may update these Terms by posting a revised version and changing the effective date. Changes apply prospectively from the posted effective date. If applicable law requires additional notice or consent, we will provide it.

18 Severability and Entire Agreement

If any provision of these Terms is found unenforceable, the remaining provisions remain in effect, and the unenforceable provision will be enforced to the greatest extent permitted by law. These Website Terms, the Privacy Policy, the SMS Terms below, and any applicable project-specific agreement form the agreement governing the matters they address.

Part Two SMS Terms and Conditions

1 Program Description

LXRY HAÜS may operate one or more text message programs for customers and prospective customers. Messages may include responses to inquiries, appointment confirmations and reminders, estimate and project updates, service notices, review requests, recruiting communications, offers, and marketing messages. Enrollment in one program does not automatically enroll you in every program.

2 Consent to Receive Text Messages

When you provide your mobile number and affirmatively agree to receive texts, you authorize LXRY HAÜS and service providers acting on its behalf to send text messages to that number. Depending on the disclosure presented when you enroll, messages may be sent using automated technology. Marketing consent applies only to LXRY HAÜS unless the enrollment disclosure clearly identifies another seller.

Your consent to receive marketing text messages is not a condition of purchasing any goods or services. You may still contact us through the website or by phone without agreeing to marketing texts.

3 Message Frequency and Charges

Message frequency varies based on your interactions, appointments, project activity, and the program you joined. Message and data rates may apply under your wireless plan. LXRY HAÜS does not charge a separate fee for text messages.

4 Opting Out

You may revoke consent at any time. Reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT to a message, or communicate another reasonable request that clearly tells us you do not want further texts. We may send one confirmation message after receiving your request. We will honor a valid revocation request within the time required by applicable law.

An opt-out request may stop messages from the text program associated with that number. Messages required to complete an existing transaction or respond to a separate request may be sent when legally permitted. If you later ask to re-enroll, we may require new consent.

6 Mobile Number Ownership

You represent that you are the subscriber or customary user of the mobile number you provide and that you are authorized to consent to messages at that number. If you change, surrender, or transfer the number, you agree to opt out before doing so and notify us if necessary. You are responsible for keeping your contact information current.

7 Supported Carriers and Delivery

Text delivery is subject to your wireless carrier and network availability. Carriers are not liable for delayed or undelivered messages. LXRY HAÜS does not guarantee that every message will be delivered or received. The program may not be available on every device, carrier, or location.

8 Privacy and Data Use

We use information associated with the text program to send messages, maintain consent and opt-out records, respond to requests, support customers, improve communications, protect our rights, and comply with law. Our Privacy Policy provides more information about our data practices. We may use messaging vendors and other service providers to operate the program. We do not authorize those providers to use your mobile information for their own marketing.

9 Age and Eligibility

You must be at least 18 years old and authorized to use the mobile number to enroll in the text program.

10 Program Changes and Termination

We may change or discontinue a text program at any time. We may suspend messages to a number if we believe the number has been reassigned, the user has opted out, the messages create a security or compliance risk, or continued messaging would violate law or carrier requirements.

11 Disputes and Applicable Terms

The governing-law, limitation-of-liability, severability, and changes provisions in Part One also apply to the text message program to the extent permitted by law. Nothing in these SMS Terms limits rights or remedies that cannot lawfully be waived.
